This paper examines the functions of narrative within legal argumentation. My purposes are these: 1) to repudiate common assumptions that differentiate ‘argumentation’ and ‘storytelling’ in the law; 2) to begin to theorize anew how legal argumentation functions; 3) to explore the difficulties of evaluating the law's argumentative narratives; and 4) to trace some of the anxiety that judges themselves reveal about their roles as storytellers. I conclude that narrative is necessary to law's claims to authority, even as it complicates our (...) understandings about how legislative policy decisions produce effects, and even as judges themselves seek to mask its importance. At first the confrontation was purely intellectual, as writers on ethical theory (within phi losophy, theology, or other humanistic disciplines) turned their attention to topics from the (...) world of medical practice. Recently the confrontation has grown more intense. The ap pointment of clinical ethicists in hospitals and other health care settings is an accelerating trend in North America. Concomitantly, those institutions involved in training peo ple in clinical ethics have added organized exposure to the world of practice, in the form of placement requirements, to the normal academic course load. In common with other dis ciplines, bioethics has begun to see clinical training as a con dition of didactic theory and apprenticeship. (shrink)

Advance refusals of life-sustaining treatment involve three potentially conflicting interests: those of the patient; those of the doctor; and those of the law. The state's interest in protecting life can clash with the patient's right to self determination which, in turn, can conflict with the doctor's desire to act in the patient's best interests. Against this background, we present the case of a patient who was treated (arguably) contrary to his advance refusal but in accordance with English law.

Scientific instruments can help to shape and re-shape epistemic boundaries, especially those between communities of scienti?c researchers. But how do they function at boundaries between scienti?c communities and communities of non-experts? This paper examines the use of air monitoring instruments at the boundary between petrochemical facilities and nearby residential communities, asking whether a new generation of fenceline monitors shared by industry (and regulatory agency) experts and community members alter the epistemic boundary between the two groups. Arguing that epistemic communities organized (...) around instruments are characterized, in part, by a common understanding of the evidential contexts for instrumental data, the paper shows how the evidential contexts in which experts and residents interpret monitoring data diverge. Instead of the new, shared fenceline monitors helping to reconcile differences over evidential contexts, those pre-existing contexts shape the interpretation of data from the new instruments–perpetuating epistemic boundaries between industry experts and community members. What ecological advantages do animals gain by being able to detect, extract and exploit wavelength information? What are the advantages of representing that information as hue qualities? The benefits of adding chromatic to achromatic vision, marginal in object detection, become apparent in object recognition and receiving biological signals. It is argued that this improved performance is a direct consequence of the fact that many animals' visual systems reduce wavelength information to combinations of four basic hues. This engenders a simple categorical (...) scheme that permits a rich amount of sensory information to be rapidly and efficiently employed by cognitive machinery of limited capacity. (shrink)

Recently, Brukner and Zeilinger 3354) have claimed that the Shannon information is not well defined as a measure of information in quantum mechanics, adducing arguments that seek to show that it is inextricably tied to classical notions of measurement. It is shown here that these arguments do not succeed: the Shannon information does not have problematic ties to classical concepts. In a further argument, Brukner and Zeilinger compare the Shannon information unfavourably to their preferred information measure, I , with regard (...) to the definition of a notion of “total information content.” This argument is found unconvincing and the relationship between individual measures of information and notions of “total information content” investigated. We close by considering the prospects of Zeilinger's Foundational Principle as a foundational principle for quantum mechanics. (shrink)

Stephen Yates's objections to Feyerabend's political theory (Inquiry 27 [1984], 137?42) are presented in a way that makes them unnecessarily vulnerable to a rhetorical strategy often employed by Feyerabend. Like many other critics, Yates seems to assume that it is the implausibility of Feyerabend's claims that opens them to refutation, whereas it is really this that makes them such slippery targets of criticism. Rather than claim that Feyerabend's ideal would be virtually impossible to realize, I argue that Feyerabend does not (...) demonstrate why ?democratic relativism? is at all desirable. (shrink)

Анотація. У статті проводиться аналіз текстів донікейських Отців, які показують сприйняття ними водного хрещення. Зокрема, розглядаються праці чотирьох видатних богословів, що писали свої праці в III ст. – Орігена, Іполита Римського, Тертуліана і Кипріяна. На підставі їхніх текстів, що відбивають розуміння водного хрещення в різних регіонах Римської імперії, проводиться вивчення процесу формування дитячого хрещення, який активно проходив у цей період. Автор визначає фактори, що зробили значний вплив на заміну кредохрещення на педохрещення. Провідну роль в появі дитячого хрещення зіграли ситуації екстремального (...) хрещення, за умов якого суворі правила входження в громаду могли ігноруватися. Богословською підставою таких дій було уявлення про роль хрещення як очищення гріхів, яке поступово трансформувалося з прощення гріхів по вірі кандидата на хрещення на прощення гріхів ex opera operato. Так як в богослов’ї цієї епохи відсутнє поняття первородного гріха, то для пояснення хрещення невинних немовлят стало розвиватися орігенівське уявлення про так звану «пляму гріха». (shrink)

Among the scanty remains of poetry attributed to Eumelus of Corinth two lines 2 stand out as different from the rest, first because they are concerned not with the legendary past but with an actual, present occasion, and secondly because they are composed not for Corinthians but for Messenians. Our evidence comes from Pausanias and may be set out at the start.

Studies suggest that when a language requires grammatical marking of future events, speakers prefer immediate payoffs and engage in less future-oriented behavior. If future costs of tax avoidance are non-trivial, we posit that strong future time reference in languages would lower managers’ perceptions about costs, encouraging more tax avoidance. Using a large sample of 56,243 firm-year observations across 31 countries, we find that tax avoidance is higher where FTR in the language is strong. We also find that tax avoidance is (...) more prevalent in Swiss regions with strong FTR and in US firms whose CEOs were born in countries with strong FTR. Collectively, our evidence suggests that costs of tax avoidance can be non-trivial, and that linguistically driven time perception helps explain the cross-country variation in tax avoidance. Both hypotheses are confirmed, if the identification of two new fragments is admitted.At 10. 11 p. 368, Zonaras is epitomizing the text of Caes.; he recounts the Story of Caes. 60. 3, and continues: Editors leave the provenance of the passage unspecified: ‘addita sunt pauca de nomine Caesaris‘. The correction of the vulgar error might (...) perhaps be an inference of Zonaras himself—though such an original contribution to historical polemic would be unique; but the erroneous version, at least, must come from somewhere. It is not found in any of Zonaras' sources for this period, nor in any surviving book which he certainly knew. Nor is it likely to be an addition from his own general knowledge. (shrink)
